This website offers visitors items & services for sale. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Sweet Sounds, Inc and/or their respective owners. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment
You agree to indemnify and hold Sweet Sounds, Inc harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
To the maximum extent permitted by applicable law, in no event shall Sweet Sounds, Inc be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Sweet Sounds, Inc assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the City of Mankato, County of Blue Earth, State of Minnesota, USA, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in City of Mankato, County of Blue Earth, State of Minnesota, USA,. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

RETURNS AND REFUNDS:
Items purchased via this site (Sweet Sounds.biz) and picked up from or shipped from our physical store may be returned and refunded within 30 calendar days of purchase date. To be eligible for a return, your item must be new and unused and in the same condition that you received it. Your item must be in the original, undamaged packaging. Your item needs to have the receipt or proof of purchase. Items that have been installed in a vehicle are not eligible for return or refund under any circumstance. Items must be returned to Sweet Sounds, 1418 N Riverfront Dr, Mankato, MN 56001.
Once we receive your item, we will inspect it and notify you that we have received your returned item. We will notify you on the status of your refund after inspecting the item. If your return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer's policies.
You will be responsible for paying for your own delivery or shipping costs for returning your item. Shipping costs are nonrefundable. If you receive a refund, the cost of shipping will be deducted from your refund. Please contact us if you have any questions on how to return your item to us.
Cancellation: : Orders placed via this site (Sweet Sounds.biz) that the customer has yet to pick up from our physical store may be cancelled within 30 calendar days of purchase date. Please contact us at Info@SweetSounds.com to process a cancellation. Beyond 30 days after purchase date, orders may not be cancelled and the goods will remain at our physical store to be picked up during normal business hours. Shipping, at additional cost, may be arranged under special circumstances. Any order not picked up after 365 calendar days will be forfeited.

GENERAL POLICIES:
Full payment is due upon completion of services and before any property or vehicles may be removed from the premises. A 1.5% penalty per month will be charged for any overdue balances. A $20 per day storage fee may be applied to any vehicle which is not picked up and paid in full upon demand by Sweet Sounds. Payment for any bad check may be sought electronically. If legal action is required for collection of this bill, the buyer will be responsible for all legal expenses, including attorney fees incurred by Sweet Sounds. If Sweet Sounds prevails concerning any legal action, the buyer will pay Sweet Sounds attorney fees.
It is the customers responsibility to use products in accordance with manufacturers recommendations. The customer will bear all responsibility for use beyond those recommendations. Some of the products offered by Sweet Sounds are designed for off road or “show” use only. Compliance with local, state and federal laws is solely the users responsibility.
Any vehicle damage must be reported to Sweet Sounds within 24 hours of vehicle departure from our facility. Sweet Sounds is not responsible for in transit damages. Sweet Sounds is not responsible for scratches or marks in a vehicles finish if the vehicle was dirty at the time of vehicle arrival at our facility. Customer gives Sweet Sounds permission to operate vehicle on private and public roadways as needed to perform work requested.
We bill in 1/2 hour increments with a half hour minimum charge. All work is performed by appointment.

LIMITED WARRANTY
What is covered & How long coverage lasts:
Installation Services / Labor: Sweet Sounds guarantees that our Installation Services will be performed in a good and workmanlike manner and guarantees the Installation Services against defects in workmanship and materials for a period of one (1) year or 12,000 miles from the date of completion, whichever occurs first, with the exceptions stated below when the Installation Service is used to install new products purchased from Sweet Sounds. For all other products, including products previously purchased from Sweet Sounds and for new or used products purchased elsewhere, we offer a thirty (30) day, unlimited mileage Installation Services warranty.
Products: A “pass-through” warranty is offered for products manufactured by other companies that are sold by Sweet Sounds. Warranties on these products are “pass-through”, meaning the equipment warranty will be limited to that offered by the equipment’s original manufacturer and that the warranty will exist solely between the manufacturer and purchaser. Exceptions will be by prior written contractual agreement only. Products manufactured by Sweet Sounds are guaranteed to be free from defects in materials and workmanship for one (1) year or 12,000 miles, whichever occurs first, with the exceptions stated below.
This warranty is not transferable:
Coverage terminates if you sell or otherwise transfer the product or Installation Services to a different owner or to a different vehicle.
What is not covered:
This warranty does not cover batteries or damages due to failure to follow directions, improper maintenance, abuse, misuse, unauthorized modification, neglect or acts of God. Also, this warranty does not cover products that have the serial number removed or defaced or warranty stickers removed or altered in any fashion. In addition, this warranty is voided if the product(s) or Installation Services have been modified by anyone other than Sweet Sounds staff. Consequential and incidental damages are not recoverable under this warranty. Sweet Sounds is not responsible or liable for any damages whatsoever, including but not limited to, any consequential damages, incidental damages, damages for loss of time, loss of earnings, commercial loss, loss of economic opportunity and the like that may or may not result from the purchase or operation of products or purchase or use of Installation Services rendered by Sweet Sounds. The remedy of replacement or repair of any defective goods shall be the exclusive remedy under this warranty and in all cases will be limited to the original purchase price of the goods or services. Sweet Sounds does not reimburse travel charges or rental car fees incurred due to warranty work. Sweet Sounds reserves the right to deny warranty on any products or Installation Service. Notwithstanding the above, Sweet Sounds does offer a limited warranty as described herein.
What Sweet Sounds will do:
Installation Services / Labor: Sweet Sounds will repair or replace, at Sweet Sounds discretion, any Installation Service deemed covered by the warranty that proves to be defective in material or workmanship.
Products: For “pass-through” products, Sweet Sounds will repair or replace, at the manufacturer’s discretion, any product deemed covered by the manufacturer’s warranty that proves to be defective in material or workmanship. For products manufactured by Sweet Sounds, Sweet Sounds will repair or replace, at our discretion, any product deemed covered by the warranty that proves to be defective in material or workmanship. In the event replacement is necessary, the product may be replaced with a comparable item including possible replacement with a refurbished item.
Charges may apply:
Sweet Sounds will charge a diagnostic fee based upon our currently advertised hourly rate at the time services are rendered for any service requested on any product or Installation Services that is found to not be covered by the manufacturer's or Sweet Sounds warranty.
How to get service:
Warranty service requires original proof of purchase. Contact Sweet Sounds at (507) 345-8863 or visit us at 1418 N. Riverfront Dr, Mankato, MN 56001 during normal business hours. All warranty work is performed by appointment. Drop in warranty service is not available. It is the purchasers responsibility to return the vehicle to Sweet Sounds for warranty work to be performed. Warranty work will not be performed for accounts that are past due. Sweet Sounds does not reimburse for service work performed by other parties without prior written authorization from our President.
Severability:
In the event that any of the provisions of the Limited Warranty shall be held invalid, the remainder of the provisions of the Limited Warranty shall remain in full force and effect.
How state law applies:
This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
